You have undoubtedly seen new CBD stores start popping up all over Amarillo, leaving many to ask “what is CBD?” Is CBD marijuana? How is CBD made? What are the benefits of CBD? What prompted this flood of CBD stores to Amarillo?
In December 2018, President Trump signed off on the 2018 Farm Bill which was a unique Bill involving the cannabis plant. For a little bit of background, hemp is defined in the legislation as the cannabis plant (yes, the same one that produces marijuana) with one key difference: hemp cannot contain more than 0.3 percent of THC (the compound in the plant most commonly associated with getting a person high). In short, hemp can’t get you high. For decades, federal law did not differentiate hemp from other cannabis plants, all of which were effectively made illegal in 1937 under the Marihuana Tax Act and formally made illegal in 1970 under the Controlled Substances Act—the latter banned cannabis of any kind.
The 2018 Farm Bill allowed hemp cultivation broadly, not simply pilot programs for studying market interest in hemp-derived products. It explicitly allows the transfer of hemp-derived products across state lines for commercial or other purposes. It also puts no restrictions on the sale, transport, or possession of hemp-derived products, so long as those items are produced in a manner consistent with the law. The 2018 Farm Bill was an extension on the 2014 Farm Bill enacted to protect and generate research into hemp.(1)
On June 10, 2019 Governor Gov. Greg Abbott signed a new law (HB 1325, relating to the production and regulation of hemp) that clears up which CBD products are legal in Texas and also allowed local farmers to grow hemp as a crop.
It allows Texas to set up a federally approved program for farmers to grow hemp as an industrial crop, including procedures for sampling, inspection and testing. It also expands the kind of hemp products that can be legally purchased in Texas to include any hemp or hemp-derived products containing less than 0.3 percent of THC, or tetrahydrocannabinol, the psychoactive compound found in cannabis plants.
This includes cannabidiol, or CBD, products. While Texans have found oils, tinctures and other CBD goods on store shelves for years, those that contained even trace amounts of THC were technically illegal here. Now, as long as these products are derived from hemp, contain less than 0.3 percent THC and meet other labeling and quality standards, they are legal. Marijuana remains illegal in Texas.
“I am excited that we have taken one more step towards giving producers in Texas the opportunity to grow hemp,” Agriculture Commissioner Sid Miller said in a statement. “Texas will be a leader in hemp production, and we will be submitting our plan and writing rules to follow the 2018 Farm Bill and the law recently enacted in Texas. “This will be another tool for farmers that are looking to diversify their farming operations.”
The federal government removed hemp from its list of controlled substances, a move the Lone Star State replicated in April. But unlike the 42 other states who had already opted into industrial hemp production, Texas had not, a decision farmers said was holding them back from tapping into a lucrative and popular crop. (2)

So how does CBD oil work? CBD is one of more than 120 compounds called cannabinoids. Unlike other cannabinoids, such as tetrahydrocannabinol (THC), CBD does not produce a euphoric “high” or psychoactive effect. This is because CBD does not affect the same receptors as THC. The human body has an endocannabinoid system (ECS) that receives and translates signals from cannabinoids. It produces some cannabinoids of its own, which are called endocannabinoids. The ECS helps to regulate functions such as sleep, immune-system responses, and pain.(3) According to Sherry, “Pain is caused by inflammation.
